Liviu STOICESCU, B.A.A.R.: Motor Hull has been the engine of growth for fraud, and not the amicable report


"Regarding the percentage of fraud in insurance, in Romania it exceeds 15%, under the circumstances in which the international system is accepted with a rate of 5%, and I refer here not only to fraud identified following the application of the amicable report. Actually, Motor Hull insurance has been the engine of growth of fraud in motor insurance, in the context in which many companies have closed their activity, unemployment rate rose and salaries decreased, many insured choosing to fraud the insurer", said the President of B.A.A.R., Liviu STOICESCU.

Thus, the number of total claims increased a lot (cases in which vehicles "have found their end" on bridges, in lakes or in fires) and, also, there were multiplied the thefts in which the car has disappeared. Thus, there is an increase of over 125% of the combined claims rate on the Motor Hull segment. 

"The amicable report worked because insurers can control the guilt or responsibility of drivers involved in a road event. In most cases, the insurer accepts the statements of the two, as they come together to the insurer. However, in the daily activity, many of these accidents are fictitious and do not go further from the insurer, that identifies what really happened", said Liviu STOICESCU.

According to him, in Western countries there is a system of also reporting the event to the one that penalties the deed, but in the case of the amicable report procedure in Romania, the Police is no longer involved (does not give fines, does not suspend the driving licence, does not know if the driver was drunk or not etc.). Thus, a report concluded by the Police could have been contested only by those involved and it was hard to disprove. In the situation of the amicable report, the insurer may intervene in the dynamics of the accident and may either refuse to pay claims if an attempt of fraud is identified, or establish a common fault.
